While Samoa does not yet have PPP specific legislation, procurement rules are generally applied, however they make PPP arrangements unfeasible due to the out-dated contract law and dispute resolution framework.
There is only a few examples for private participation in infrastructure: privatization and regulation of the country’s telecommunications sector and a range of public works projects such as road maintenance and aviation as well as privatization of the Virgin Samoa airlines. In addition, the cabinet adopted a new PPP policy in December 2014, which currently exists in draft form and has not yet been formally approved.
