The Investment Code ensures general guidelines for the implementation of concessions and investment agreements with PPP features in Belarus. Specific terms are usually defined on a project-by-project basis and require presidential approval. There is no specific legal framework that allows for concessions to be conducted on a regional level, though other PPP-style projects may be implemented via the Investment Agreement mechanism. Despite government authorities’ technical capacity and experience in infrastructure development with private participation, PPP implementation remains a challenge. This may in part be due to the lack of a PPP Framework. Since 1996, the private sector has been involved in divestitures in energy, transport, and water and sanitation projects, with the largest investment going to the energy sector.
